Who is responsible for the data
The controller of the personal data described in this policy is the law firm Marinho Barcellos e Costato Advogados, headquartered in Brasília, at the Victoria Office Tower, Setor de Autarquias Sul, Quadra 4, Sala 930, Asa Sul, CEP 70297-400, Brasília/DF, Brazil. Processing follows Brazil's General Data Protection Law (Law No. 13,709/2018, the LGPD).
Which data is processed
The website has no forms, registration or login area. The data processed is of four types:
- Browsing data. Technical information about the visit, such as the pages viewed, the type of device and browser, the origin of the visit (for example, a search or a link) and clicks on contact links. Usage measurement only takes place if you allow it (see section 3).
- Server technical data. As with any website, the hosting provider records the IP address and basic data of each request, for security and operation.
- Data you choose to send. When you tap a contact link, the conversation takes place outside this website, on WhatsApp or by phone. What you write or say, including your name, phone number and a description of your case, reaches the firm through that channel.
- Your cookie choice. The website stores on your device the decision you made in the cookie notice.
The website does not request sensitive data or documents. If it is necessary to process information of that kind to analyze your situation, this happens only during service, under the confidentiality described in section 6.
Cookies and storage on your device
Cookies and similar resources are small records stored in your browser. Those necessary for the website to work are always active. Analytics and advertising cookies are only activated if you allow them in the notice shown on your first visit, and the decision can be reviewed at any time.
The necessary cookies store your choice and the origin of the visit. The analytics ones are Google Analytics cookies. The advertising ones are Google cookies, used to measure the reach and results of the firm's institutional communication.
How to change your choice: use the Cookie preferences link in the footer of any page. You can also delete or block cookies in your browser settings, which may affect how some features work.
What the data is used for
Each use has a legal basis under the LGPD:
- Website operation and security. Keeping the page online, preventing abuse and storing your cookie choice. Basis: legitimate interest (art. 7, IX).
- Measuring usage and results. Understanding, in aggregate, which content is accessed and how the firm's communication reaches people, in order to improve the website. Basis: your consent (art. 7, I), which can be withdrawn at any time.
- Responding to your contact. Reading and answering the message you send through WhatsApp or by phone. Basis: preliminary procedures related to a possible contract, at the request of the data subject (art. 7, V).
- Legal and regulatory obligations. Complying with duties that legislation and the rules of the legal profession impose on the firm, and exercising rights in judicial, administrative or arbitration proceedings (art. 7, II and VI).
The data is not used for automated decisions or to build profiles of identified people.
Who the data may be shared with
- Google. Provides the measurement tools (Google Tag Manager, Google Analytics and Google Ads) and receives browsing data for the categories you allow.
- Vercel. The company that hosts the website and processes technical access records.
- WhatsApp (Meta). If you choose to contact the firm through WhatsApp, the conversation is also governed by the application's terms and privacy policy.
- Instagram and YouTube. Links to these networks lead to third-party websites with their own policies. The firm does not control what they collect.
The data is not sold or transferred to third parties for commercial purposes. The providers above may process information on servers outside Brazil, and this international transfer takes place in the cases provided for in art. 33 of the LGPD, with the safeguards adopted by each provider. The firm may also share data when required by law or by court order.
Professional confidentiality
Information you share with the firm when seeking legal guidance is protected by the professional secrecy of the legal profession, provided for in Brazil's Statute of the Legal Profession (Law No. 8,906/1994) and in the Code of Ethics and Discipline. It is used only to analyze your situation and, if you hire the firm, to carry out the work. Avoid sending documents or details through WhatsApp that are not necessary for the first contact.
How long the data is kept
Browsing data is kept in your browser for different periods: the origin of the visit, until you close the tab; Google Analytics cookies, for up to 2 years; Google advertising cookies, for up to 90 days; and the origin of the first visit and your cookie choice, until you withdraw permission, change the choice or clear your browser data.
Information exchanged during service is kept for up to 5 years, counted from the last contact or from the end of the service. After that period, it is deleted or anonymized, unless the law requires a longer period or a proceeding is under way.
Changes to this policy
This policy may be updated, for example to reflect changes to the website or to the law. The date of the current version appears at the top of the page. The Portuguese version is the original text.
